Judge gives Fremonter another shot at probation

A Fremont woman was given a second chance at probation Monday in Dodge County District Court.

Christina K. Mount, 36, of Fremont was sentenced to three years of intense supervised probation for possession of controlled substance-methamphetamine, a Class IV felony. That probation will run concurrently with one on another charge of possession of meth. The first 90 days of Mount’s probation she will be electronically monitored.

Mount recently completed one month of inpatient drug treatment and a followup outpatient treatment program.

“The defendant has made some positive steps, but that should have happened the first time,” said Dodge County Attorney Paul Vaughan as he asked for a prison sentence. “I have trouble recommending probation for someone convicted of the same crime they were on probation for.”

Defense attorney Brad Holtorff argued his client’s efforts to stay clean and sober made her a fit candidate for intense supervised probation.

“This is your second chance ma’am,” said Judge John Sampson, adding her efforts to stay clean got Mount that second chance. “You don’t want to come back here a third time.”

Other cases heard Monday included:

* Brett Buckingham, 36, of North Bend had his sentencing for sexual assault of a child, a Class IIIA felony, continued until Sept. 11, however, his bond was revoked and he was remanded to jail. The continuance was requested to allow Buckingham to pay for a completed psychiatric evaluation so the report could be sent to the court. Buckingham originally was scheduled for sentencing Aug. 7, but requested a two-week continuance for the same reason.

* Sh-Ron Roby, 19, of Omaha had his probation revoked and was sentenced to 18 months to four years in prison for strangulation, a Class IV felony. Last week he admitted to violating his probation by testing positive for marijuana July 5 after returning from the work ethic camp. He was sentenced Feb. 21 to three years of intense supervised probation with the first four months at the work ethic camp.

* A motion to revoke the 2004 bond of Jose Rodriguez-Jimenez, 28, of Omaha was granted and his arraignment was continued until Aug. 28. In July 2004, Rodriguez-Jimenez pleaded innocent to possession of stolen property, a Class III felony; driving under the influence-fourth offense and driving during a 15-year suspension, both Class IV felonies; and false reporting, a Class I misdemeanor. He failed to show up for further proceedings on July 24 and once again after the matter had been continued.

* Michael Schneider, 21, of Fremont admitted to violating his probation for burglary, a Class III felony, by being unsatisfactorily released from the work ethic camp on Aug. 8. Schneider was on three years of probation for burglary, a Class III felony, with an initial four-month stay at the camp. A pre-sentence investigation was ordered and sentencing set for Sept. 25.

* Cynthia Seip, 51, of Fremont pleaded guilty to attempted possession of a controlled substance-methamphetamine and resisting arrest, both Class I misdemeanors. In exchange for her plea, the drug charge was amended from possession of a controlled substance-methamphetamine, a Class IV felony, and the infractions of possession of marijuana-less than an ounce and possession of drug paraphernalia were dismissed. A pre-sentence investigation was ordered and sentencing set for Sept. 25.
