Fremont man sentenced to one year in prison

A Fremont man facing

two new felony charges for threatening a witness from jail was sentenced to prison Tuesday in Dodge County Court.

Joseph Brainard, 22, was sentenced to one year in prison for attempted terroristic threats and writing an insufficient funds check, Class I misdemeanors. He also was ordered to pay

$266 in restitution.

“This court has sentenced Mr. Brainard to the state penitentiary several times in the past for stalking and delivery of a controlled substance,” said Deputy Dodge County Attorney Mark Boyer. “He has two felonies pending as we speak.”

Boyer asked for at least a one year sentence.

Judge Kenneth Vampola sentenced Brainard to one year in prison for the attempted making terroristic threats charge and a concurrent 30 days for the insufficient funds check.

Brainard is scheduled for a July 15 arraignment for new charges of stalking-second offense, tampering with a witness and four counts of violating a protection order second offense, Class IV felonies, and obstructing a peace officer, a Class I misdemeanor. Leo Eskey was appointed to represent him in that case.
