A Fremont man accused of stalking a woman who had a protection order against him was sentenced to up to four years in prison Tuesday in Dodge County District Court.
Joseph D. Brainard, 23, was sentenced to 18 months to four years in prison for stalking-second offense and violating a protection order-second offense, Class IV felonies. The sentence will run concurrently with a Dodge County Court sentence issued July 1.
Deputy Dodge County Attorney Mark Boyer said this was Brainard’s fourth conviction for violating a protection order and his second for stalking. He also said Brainard had served three sentences in the penitentiary and requested a fourth.
“You’ve got to have some restraint and some control. We all have rules and laws we have to follow,” Judge John Samson said. “You have to think about where you want to be in five years because the sentences just get longer.”
Other cases heard Tuesday included:
n A psychological evaluation was ordered for Jonathan Carlson, 27, of Fremont. His court-appointed attorney, Mike Wiseman, was granted a motion to withdraw as his attorney because of a conflict and Pam Hopkins was appointed to represent him. A Sept. 8 status hearing was set.
Carlson is charged with making terroristic threats, false imprisonment and possession of a controlled substance-methamphetamine, Class IV felonies; domestic assault, a Class I misdemeanor, and violating a protection order, a Class II misdemeanor.
